Companies try and "skirt" the law by attempting to justify illegal and unlawful actions, but in the end, THEY are at fault for letting it happen and for, at times, supporting it by failing to take action and by taking improper action(s).
Never let a company violate your rights based upon your "protected classes" which are age, sex, religion, ethniticity, sexual orientation, disposition, disability (mental and physical), social status and more. You automatically are in a "protected" state from retaliation when you bring a claim forth internally at work which need not be in writing (verbal is fine with HR or management). You are protected from threats and retaliation even if the company finds no internal merit on your claims. This means you cannot be subject to ANY adverse action including firing, demotion with pay loss, demotion with no pay loss, removal from emails, memos and meetings, and other adverse actions meant to cause "status" loss and emotional duress as punishment for bringing claims against senior staff or other employees. Harrassment is a correlated form, per the US Supreme Court, of an act of discriminative behavior and subject to review for "creating a potential hostile working environment." This can be something as simple as making a "sexual joke" in your presence knowing it would offend you and/or others.
Employees testifying in a claim are protected from retaliation under Title VII. Any management or company representative telling employees to not speak to a claimant or to not participate in a former employee's/employee's investigation and/or court proceeding for fear of job reassingment or loss is subject to heavy fines, penalties and more.
Basically, if you make claims, and show a short time frame of threats against you versus a discharge or lay off in direct relation, you have proven and can win RETALIATION damage compensation and subject that company to citations for violations. Our ancestors fought hard for civil rights in the workplace. We as their decendants and citizens of the United States must defend them and see to it they are upheld. We must hold them "accountable."
